Who is the policyholder of a car insurance  

 

The policyholder of a car insurance policy is the holder of the insurance contract. As the contracting party, the policyholder is responsible for obligations such as signing the agreement and paying the insurance premium.

However, the policyholder is not necessarily the same person as the insured. Insurance protection is granted to the driver or drivers of the vehicle, who may or may not be the policyholder.

From a legal perspective, the policyholder is the individual whose details appear on the insurance document, who signs the contract and who assumes the obligation to pay the premium. Although, in most cases, the policyholder is also the beneficiary of the insurance cover, the Spanish Insurance Contract Act (Ley del Contrato del Seguro) allows a policy to be taken out either on one’s behalf or on behalf of a third party.

This distinction may arise in a wide range of situations. For example, a parent may take out a car insurance to ensure their child is covered while driving, or a company (or legal entity) may arrange insurance for vehicles used by its employees.

It is therefore essential to understand the applicable legal framework in order to clearly define the rights and obligations of each party. When the policyholder and the insured are different individuals, the policyholder assumes the contractual duties and obligations, while the insured person benefits from the cover and guarantees provided under the policy.

Obligations of the policyholder of a car insurance policy

 

As noted above, the policyholder is the person who takes out the insurance, either for themselves or on behalf of a third party. In addition to signing the contract, the policyholder is subjected to the following obligations:

  • Payment of the insurance premium: This is the policyholder’s primary responsibility. Failure to pay under the terms stipulated in the policy may entitle the insurer to refuse compensation in the event of a claim.

  • Disclosure of relevant information: The policyholder must inform the insurer of all information and circumstances relevant to the assessment of the risk. Misrepresentation or omission of relevant facts may entitle the insurer to terminate the contract.

  • Notification of changes in risk: The insurer must be informed of any circumstances that significantly alter the risk after the policy has been taken out, whether such changes increase or decrease the level of risk.

  • Notification of claims: Any accident or loss must be reported to the insurer within a maximum period of seven days, unless the policy establishes a longer timeframe. Failure to comply may entitle the insurer to claim damages and, in cases of willful misconduct or gross negligence, may result in the loss of the right to compensation.

  • Mitigation of loss: The policyholder must take all reasonable measures within their reach to minimise the consequences of the loss. Failure to do so may lead to a reduction in the compensation payable or, in cases of bad faith, to the loss of entitlement altogether.

    The rights and obligations of the parties to a car insurance contract are regulated by Ley 50/1980, de 8 de octubre, de contrato de seguro, specifically in Articles 14 to 21.
