How to exercise your data protection rights
What are LOPD rights?
The aim of the Personal Data Protection Act [Ley de Protección de Datos de Carácter Personal - LOPD] is to guarantee and protect natural people’s rights to public freedom and fundamental rights, especially in regards to their honour and personal and family privacy in regards to processing personal data.
Rights of access, rectification, erasure and objection to personal data all figure in the measures which guarantee that these rights are protected.
Right of Access.- This is the right to obtain information on whether one’s data is being processed and for what purpose, their source and the communications through which the data was released, as well as to be able to access the content of the processed data.
Rights of Rectification.- The right to modify any data that may be inaccurate or incomplete.
Rights of Erasure.- The right to remove inappropriate or excessive data.
Rights of Objection.- Right to object to one’s data being used or that it stop being used in the following cases: When one’s consent is not necessary for the data to be used, provided that there is a legitimate reason based on a specific personal situation and there is no Law stating the contrary. In the instance of files dedicated to advertising or surveys. When the purpose of automatically processing the data is to make a decision in regards to the person affected and is aimed at assessing aspects such as their performance in their job, their credit capacity, their loyalty or conduct.
